Under the motto “FlexCo: A double opportunity”, Keyvan Rastegar moderated a panel of practitioners and academics on September 27, 2024 to discuss FlexCo in greater depth at the Anwaltstag 2024 of the Austrian Bar Association ÖRAK.

After a keynote speech by Dr Georg Adler, MSc (Oxford), who emphasized the double opportunity for both the Austrian economy as well as for the legal profession, Univ.Prof. Dr. Susanne Kalss, Univ.-Prof. Dr. Martin Schauer, Dr. Elke Napokoj, Hon.-Prof. Dr. Gernot Murko and Univ.-Prof. Dr. Julia Told discussed the most exciting innovations of FlexCo, the advantages and disadvantages of setting up a FlexCo, the advantages of converting a GmbH into a FlexCo, the practical requirements of a § 12-FlexKapGG private deed and the structuring options that the FlexCo offers for the various professions, in particular for attorneys.

The tenor from academia and practice was unanimous: Due to the flexibilization and the structuring options, there is no longer any reason to establish a GmbH from a legal point of view because the FlexCo can do everything that the GmbH can do and only more.

The newly introduced Section 11a RL-BA 2015 will provide attorneys with the necessary legal certainty regarding the § 12-FlexKapGG private deeds .
